Image encoding device comprises: a determination unit configured to determine a unit size for a unit, included in the image; a quantization unit configured to quantize data of a unit different from a predetermined unit of a plurality of units, using a quantization parameter encoded according to the processing of the predetermined unit, in the case where the quantization parameter for the plurality of units having the unit size smaller, than the minimum size related to the quantization parameter and included in the minimum size area, is encoded according to processing of the predetermined unit of the plurality of units; and an encoding unit configured to encode data quantized by the quantization unit into the encoded data.
