SUBSTANCE: invention is related to communication engineering and may be used in mobile communication systems. The invention discloses a communication apparatus and a method for a mobile communication system using orthogonal frequency division multiple access (OFDMA). The method of transmitting an uplink acknowledge channel (ACKCH) for a downlink data channel in a mobile communication system using OFDMA includes: determining channel resources for each control channel element (CCE), when a downlink control channel including at least two CCE is received; generating uplink acknowledgement information by analysing a received downlink data channel; assigning the at least two CCE to at least two transmission antennae, respectively; and transmitting the uplink ACKCH including the uplink acknowledgement information through the transmission antennae.
