SUBSTANCE: group of inventions relates to medical equipment, specifically to surgical cutting and stapling instruments, which are configured to cut and staple tissue, staple cartridges therefor and surgical staplers intended for use therewith. Surgical staple comprises a first staple leg, a second staple leg, a base, and separate and different staple ejection surfaces. Base comprises an intermediate portion, wherein the first and second staple legs extend from the base. First staple leg and second staple leg form a first plane extending in the longitudinal direction. Intermediate base portion forms a second plane that is parallel to the first plane and offset from the first plane in the lateral direction. Staple cartridge for use with a surgical stapler includes a staple body, a staple cavity and said staple. Staple cavity is formed in the cartridge body. Staple is removably disposed in the staple cavity. Ejection surfaces are adapted to move along parallel paths in the staple cartridge. Base is arranged to move along a first path, and wherein the legs are arranged to move along a second path that is parallel to the first path.
