Technical result is achieved by: receiving the reference image generation information used to generate the information of the first reference image generated using the information of the first reference image, that is used as information relating to the first reference image used under the condition that it is encoded the first image of the first layer and the second reference image information, that is used as information relating to the second reference image of the second image of the second layer and the encoded data of the first image in the first layer; generating information of the first reference image using the reference image generation information; and decoding the encoded data of the first image using the first reference picture, based on the first reference picture information generated in the generating step.
EFFECT: technical result is to improve the decoding efficiency of image data.
