Image encoding device comprises a generating unit which generates a second image, wherein the second image corresponds to a second layer which is different from the first layer to which the first image corresponds; an encoding unit which encodes a first set of fragments composed of one or more fragments in a first image, and a second set of fragments made up of one or more fragments in a second image; and an information encoding unit which encodes a message with further enhancement information (SEI), indicating a constraint associated with the decoding process of the first set of fragments and the second set of fragments, wherein the coding module encodes the first set of fragments without accessing any set of fragments in the first image, different from the first set of fragments, and encodes the second set of fragments without referring to any set of fragments in the second image, different from the second set of fragments.
