SUBSTANCE: invention can be used in systems with regulating transmission rate of user data. Control method of transmission rate for control of user data upline transmission rate based on accepted relative user data upline transmission rate, transmitter through E-RGCH, includes transmission from base radio station any of enhancement commands, which tells to enhance user data upline transmission rate, recession command, which tells to recess user data upline transmission rate, or high-elasticity state command, which tells to support user data upline transmission rate to the mobile station through E-RGCH as relative transmission rate, and support on mobile station of user data upline transmission rate. When mobile station receives recession command or high-elasticity state command, and when upline user data, which are to be transmitted, become low in transmitting buffer of mobile station.

EFFECT: data transmitting without transmitting rate recession, which allows data transmitting without delay.
