Method comprises steps of generating a first flag indicating whether the time for removing encoded data from the buffer is set by a hypothetical decoder per decoding unit or per image, wherein buffer is designed to store encoded data; generating a second flag indicating whether the interval between decoding unit decoding times is constant or arbitrary when removal times are given per decoding unit; and generating an encoded bit stream which includes encoded data and a first flag, wherein the encoded bitstream includes a second flag when the first flag indicates that removal times are given per decoding unit.

EFFECT: technical result is reduction of processing load.
