SUBSTANCE: invention relates to video encoding/decoding. Disclosed is a video encoding device which includes receiving and processing circuits which determine a parameter based on prediction information decoded from an encoded video bitstream. Parameter is in the range which depends on the flag indicating the on/off state of the motion vector temporal prediction based on the subblock. Processing circuit calculates maximum number of candidates in merge candidate lists based on subblock based on parameter and restores, in response to the current block in the prediction mode based on the subblock, the samples of the current block based on the selection of a candidate from the list of candidates for merging of the current block made on the basis of the subblock. List of candidates for merging of the current block made on the basis of the subblock is limited by the maximum number.
EFFECT: high efficiency of encoding/decoding.
